The agreement between us

These Terms of Service ("Terms") govern your access to and use of the Equiself website at equiself.app and related services (the "Service"), operated by Equiself [insert legal entity name], [insert registered address], [insert country] ("Equiself", "we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old (or the age of digital consent in your country) to use the Service. By using the Service, you represent that you meet this requirement and that the information you provide is accurate.

2. The Service

Equiself provides a symbolic self-discovery assessment, AI-generated reports, AI coaching, an evolving digital artwork, and related community features. The Service is provided for personal insight, reflection, and entertainment.

Content generated by the Service, including AI coaching, is not a substitute for professional diagnosis or treatment. If you are in crisis or need professional help, contact a qualified professional or your local emergency services.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use at support@equiself.app.

4. Subscriptions, Credits & Payments

  • Some features require a paid subscription or the use of credits. Prices are shown on our Pricing page and may change with notice.
  • Payments are processed by our payment provider, Mollie. By purchasing, you authorize us and our provider to charge your selected payment method.
  • Subscriptions renew automatically at the end of each billing period unless cancelled before renewal. You may cancel at any time from your account; cancellation takes effect at the end of the current billing period.
  • Credits and digital currency within the Service have no cash value, are non-transferable, and are not redeemable for money except as required by law.

EU/EEA / UK right of withdrawal

If you are a consumer in the EU/EEA or UK, you normally have a 14-day right to withdraw from a purchase of digital services. However, by purchasing and accessing digital content or services that begin immediately (for example, generating a report or using AI coaching), you expressly request immediate performance and acknowledge that you lose your right of withdrawal once the service has been fully performed, and that for partially used services we may retain a proportionate amount.

General refunds

  • Subscriptions: you may cancel at any time to stop future renewals. Fees already paid for the current period are generally non-refundable, except where required by law.
  • Credits: purchased credits are generally non-refundable once purchased. Unused, never-spent credit purchases may be refunded at our discretion if requested within 14 days of purchase.
  • Consumed content: reports already generated and coaching already delivered are non-refundable, as they are delivered immediately.
  • Faulty service or billing errors: if you were charged in error or the Service was materially defective, contact us and we will make it right, including a refund where appropriate.

To request a refund, email support@equiself.app with your account email and order details. We aim to respond within a reasonable time. Statutory consumer rights that cannot be waived are unaffected by this policy.

6. Digital Artwork, HerdCoins & Future NFT

The Service may display evolving digital artwork and an in-Service progression currency ("HerdCoins"). HerdCoins are a non-monetary progression mechanic with no cash value. Any references to a physical keepsake coin or a dynamic NFT describe planned, future features that are not yet available and are not part of what you purchase today. We make no guarantee that these future features will launch or take any particular form.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms;
  • Reverse engineer, scrape, or attempt to extract our methodology, source code, or data except as permitted by law;
  • Misuse, disrupt, or attempt to gain unauthorized access to the Service;
  • Submit content that is illegal, infringing, harmful, or that violates the rights of others.

8. Intellectual Property

The Service, including its text, design, methodology, software, and brand, is owned by Equiself and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for personal use. Reports and artwork generated for you are licensed to you for your personal, non-commercial use.

Your content

You retain ownership of the content you submit. You grant us a license to use it as necessary to operate and improve the Service (for example, to generate your reports and coaching).

9. Referrals & Partner Program

Referral and partner features are subject to any additional rules we publish. We may modify, suspend, or terminate these programs, and we may withhold rewards obtained through fraud or abuse.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that any insights are accurate or suitable for any purpose.

11. Limitation of Liability

To the maximum extent permitted by law, Equiself and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law, including your statutory consumer rights.

12. Indemnification

You agree to indemnify and hold harmless Equiself from any claims, damages, or expenses arising out of your misuse of the Service or violation of these Terms.

13. Termination

We may suspend or terminate your access to the Service if you violate these Terms. You may stop using the Service and delete your account at any time.

14. Governing Law & Disputes

These Terms are governed by the laws of [insert governing jurisdiction], without regard to conflict-of-law rules. Mandatory consumer protection laws of your country of residence still apply.
